Cake Care Terms of Service

Welcome to Eva Christine's Sweets. By accessing or using our website, placing an order, or engaging with any of our services, you agree to comply with and be bound by the following Terms of Service ("Terms"). Please read these Terms carefully before using our website and services.

1. General Information

1.1 Website Access
You may access our website for personal, non-commercial use, provided you comply with these Terms. You may not use the website for any unlawful purposes or in a way that could harm or disrupt the functionality of the site.

 

1.2 Eligibility
By using our website, you confirm that you are at least 18 years old or have the consent of a legal guardian. You also affirm that you are capable of forming a binding contract.

2. Ordering & Payment

2.1 Order Process
To place an order, you will need to provide necessary information such as cake details (e.g., size, flavor, design), delivery information, and payment details. All orders are subject to availability and confirmation by us.

2.2 Pricing
Prices for cakes  may vary depending on customization, size, or design. All prices are quoted in American dollars, and we reserve the right to modify pricing at any time.

2.3 Payment
We accept various forms of payment including credit/debit cards, zelle, cash app and venmo, as specified on the website. By submitting your order, you authorize us to charge your payment method for the total order amount.

2.4 Order Confirmation
Once your order is submitted, you will receive a follow up email. This is an acknowledgment of your order, but does not guarantee delivery. If we encounter any issues with your order (e.g., ingredient unavailability), we will notify you.

2.5 Retainer Fee
A nonrefundable retainer fee will be required to secure your order and booking. This retainer fee will be applied toward the total balance of your order. The retainer is nonrefundable under any circumstances.

 

 

3. Custom Orders

3.1 Cake Design & Customization
Custom cakes are subject to design feasibility, ingredient availability, and the timeline required for preparation. Any special requests for cake design must be submitted in advance and are subject to approval by us.

 

3.2 Allergies & Dietary Restrictions
It is your responsibility to inform us of any allergies or dietary restrictions (e.g., gluten-free, vegan). We will make reasonable efforts to accommodate your needs, but cross-contamination risks may exist.

4. Delivery & Pickup

4.1 Delivery
We offer cake delivery to specific areas as decided during consultation via phone, email or text. Delivery fees may apply and added to invoice. We are not responsible for delivery delays caused by factors beyond our control (e.g., weather, traffic).

4.2 Delivery Time
Delivery time is an estimate, and while we strive to deliver your cake on time, we cannot guarantee exact delivery times.

 

4.3 Pickup
If you choose to pick up your cake from our bakery, you must do so within the specified time window. We will not be responsible for cakes or desserts unavailable past the pickup time.

5. Cake Care Instructions

5.1 Storage & Handling
Upon receiving your cake, you are responsible for ensuring proper storage. Cakes should be stored in a cool, dry place and away from direct sunlight or heat. Refrigeration may be required for some cakes, particularly those with perishable fillings.

 

5.2 Transportation
If transporting the cake, it should be kept on a flat surface to avoid damage to the structure or design. We are not responsible for any damage that occurs after the cake has left our premises.

6. Responsibility After Delivery or Setup

6.1 Damage After Delivery/Setup
Once the cake has been delivered and/or set up, we are not responsible for any damage that occurs to the cake, including but not limited to physical damage, melting, or deterioration of the design. The Customer assumes full responsibility for the cake once it has been delivered and/or set up.

6.2 Customer Responsibilities
The Customer is responsible for ensuring that the cake is stored properly, displayed in a safe location, and handled with care after delivery or setup. We recommend keeping the cake in a secure area, away from heat, humidity, or any conditions that may compromise the quality or structure of the cake.

7. Returns, Refunds, and Cancellations

7.1 Cancellation Policy

Orders may be canceled up to 7 days before the scheduled delivery or pickup date for a partial refund. Retainers are nonrefundable. Cancellations made after this period may incur a cancellation fee of 35% of the total order value.

7.2 Refunds
We strive for customer satisfaction. If your cake is damaged upon delivery, please contact us within [time frame, e.g., 24 hours] with clear photos of the damage, and we will work with you to resolve the issue, which may include a refund or replacement.

7.3 No Returns
Due to the perishable nature of our products, we do not accept returns on cakes.

8. Intellectual Property

All content on our website, including but not limited to images, logos, designs, text, and trademarks, is the property of [Your Cake Business Name] and is protected by copyright laws. You may not use, reproduce, or distribute any of this content without our prior written consent.

9. Limitation of Liability
