Welcome to Eva Christine’s Sweets. These Terms of Service govern your use of our website and services. By accessing our website, placing an order, or submitting payment, you agree to be bound by the following terms.

1. General Information

1.1 Website Access

You may access our website for personal, non-commercial use, provided you comply with these Terms. You may not use the website for any unlawful purpose or in any manner that could damage, disable, or impair the functionality, security, or integrity of the site.

1.2 Eligibility

By using our website and services, you confirm that you are at least 18 years of age or have the consent of a legal guardian and that

you are legally capable of entering into a binding contract.

2. Ordering & Payment

2.1 Order Process

To place an order, you must provide accurate and complete information, including cake size, flavor selections, design details, event date, delivery or pickup information, and payment details. All orders are subject to availability, design feasibility, and formal acceptance by Eva Christine’s Sweets.

2.2 Pricing

Pricing varies based on size, complexity, customization, and design requirements. All prices are quoted in U.S. dollars. Eva Christine’s Sweets reserves the right to adjust pricing at any time prior to order confirmation.

2.3 Payment Methods

We accept credit/debit cards, Zelle, Cash App, and Venmo, as specified on the website or invoice. By submitting payment, you authorize Eva Christine’s Sweets to charge your selected payment method for the total order amount.

2.4 Order Acknowledgment

After submitting an order request, you will receive a follow-up communication acknowledging receipt. This acknowledgment does not constitute final acceptance or guarantee of fulfillment. Should any issue arise (including ingredient availability or scheduling constraints), you will be notified promptly.

2.5 Retainer Fee

A non-refundable retainer is required to secure your event date and initiate the design process. The retainer is applied toward the total order balance and is non-refundable under all circumstances, including cancellation, postponement, or change of mind.

3. Custom Orders & Design Approval

3.1 Bespoke Design & Customization

All custom cakes are uniquely designed and handcrafted. Design requests are subject to feasibility, ingredient availability, and production timelines. Inspiration images are for reference only and are not replicated exactly.

Once the final design, size, flavor(s), and decorative details are approved in writing, the order is considered confirmed. Upon design approval:

• The order becomes non-cancellable and non-refundable

• No design changes, substitutions, or modifications will be permitted

This policy reflects the time, artistry, and preparation invested in each bespoke creation.

3.2 Taste Is Subjective

Taste and texture are inherently subjective experiences. Clients are strongly encouraged to schedule a tasting consultation prior to booking.

By placing an order, you acknowledge that personal taste preference is not grounds for a refund, replacement, or dispute.

3.3 Allergies & Dietary Restrictions

You are responsible for disclosing all allergies and dietary restrictions (including but not limited to gluten-free or vegan requests) prior to order confirmation. While reasonable efforts will be made to accommodate requests, Eva Christine’s Sweets does not operate an allergen-free facility, and cross-contamination risks may exist.

4. Delivery & Pickup

4.1 Delivery

Delivery is available to select areas as confirmed during consultation via phone, email, or text. Delivery fees may apply and will be reflected on your invoice. Eva Christine’s Sweets is not responsible for delays caused by circumstances beyond our control, including traffic, weather, or venue access issues.

4.2 Delivery Time

Delivery times are estimates. While every effort is made to meet agreed-upon windows, exact delivery times cannot be guaranteed.

4.3 Pickup

Clients electing pickup must retrieve their order within the scheduled time window. Eva Christine’s Sweets is not responsible for products not collected within the agreed timeframe.

5. Cake Care Instructions

5.1 Storage & Handling

Upon receipt, proper storage becomes the client’s responsibility. Cakes must be stored in a cool, dry environment, away from direct sunlight or heat. Certain cakes may require refrigeration due to perishable fillings.

5.2 Transportation

Cakes must be transported on a flat, stable surface. Eva Christine’s Sweets is not liable for any damage occurring after the cake leaves our premises or after delivery acceptance.

6. Responsibility After Delivery or Setup

6.1 Transfer of Liability

Once the cake has been delivered, set up, and accepted—or picked up by the client—full responsibility transfers to the client. This includes, but is not limited to, damage, melting, shifting, or deterioration.

6.2 Client Responsibilities

The client is responsible for ensuring safe display conditions, appropriate temperature control, and careful handling after delivery or setup.

7. Returns, Refunds & Cancellations

7.1 Cancellation Policy

Cancellations requested seven (14) or more days prior to the scheduled event may be eligible for a partial refund of payments made beyond the retainer, less a cancellation fee of up to 35% of the total order value. Retainers remain non-refundable.

Cancellations made within seven (14) days of the event are non-refundable.

7.2 Refund Policy for Custom Orders

All custom cake orders are non-refundable once the design has been approved. Refunds will not be issued for:

• Change of mind

• Event cancellation or postponement

• Dissatisfaction based on subjective taste or preference

• Minor variations inherent in handcrafted designs

7.3 Limited Grounds for Refund Consideration

Refunds or partial refunds may be considered solely at the discretion of Eva Christine’s Sweets in the following circumstances:

• Failure to deliver the cake on the agreed-upon date and time with no reasonable alternative provided

• A substantial deviation from the approved design due to baker error

• The cake is deemed inedible due to a verified preparation issue (excluding post-delivery damage)

All concerns must be submitted in writing within 24 hours of the event, accompanied by clear photographic evidence.

7.4 No Returns

Due to the perishable nature of our products, returns are not accepted.

8. Intellectual Property

All website content—including images, logos, designs, text, and trademarks—is the exclusive property of Eva Christine’s Sweets and is protected by copyright and intellectual property laws. Unauthorized use is strictly prohibited.

9. Limitation of Liability

To the fullest extent permitted by law, Eva Christine’s Sweets shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of our website or products, including but not limited to allergic reactions, venue-related issues, or improper handling after delivery.

We respect your privacy and are committed to protecting your personal information. Please refer to our Privacy Policy for details on data collection, use, and storage.

11. Modifications to Terms

Eva Christine’s Sweets reserves the right to update or modify these Terms at any time. Changes become effective immediately upon posting.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Georgia, USA. Any disputes shall be resolved in the appropriate courts located in Georgia.
